(Al-RIBA) Interest Could Never Be Legal and Halal.--ISLAM



 Why Prohibition of Riba?
                    Are You A Muslim? Then Don’t Fool Yourself
(Al-RIBA)  Interest Could Never Be Legal and Halal.
(Correct your actions before it’s too late my friend).

           Al-Hamdu Lillaahi Rabbil ‘Alamin was-Salatu was-Salamu ‘alá Asra fil Anbiyaa wal Mursaleen.
  “There is no helper but Allah Subhanahu WA Ta’aala (GOD),
 No guide but (Prophet Muhammad Sallallaahu alayhi wasallam)
 Messenger of Allah Subhanahu WA Ta’aala (GOD),
 No provision but Taqwa.
        “My family, my possessions
        And my life is sacrificed for my most beloved Holy Prophet Muhammad       (Sallallaahu alayhi wasallam) and his honor.”

Every Muslim Should Seek Lawful Earnings
It is compulsory on every Muslim to seek lawful earnings
Prophet Muhammad (Sallallaahu Alayhi Wasallam) said:
 It is compulsory on every Muslim to seek lawful earnings.
He termed this compulsory subject as a thing of wisdom for a wise man out of other compulsory things.
 Lawful things are clear and unlawful things are also clear. Between these two,
There are doubtful things which are not clear and difficult to know.
All things are limited within these three things.

MERITS OF LAWFUL EARNINGS AND CONDEMNATION OF UNLAWFUL
In Holy Qur’an Allah says:
    Eat of the good things and do good deeds- 2:168.
    Allah ordered for eating good things before doing good deeds. The object of this order is eating of lawful things.
    Don't eat properties of one another unjustly-2:188.
    O believers fear Allah and give up what remains of interest (usury) if you are believes-2.278.
     If you do not do it, then be prepared to fight with Allah and His Prophet-2:289.
 
Meaning Of Interest or Al-RIBA
The literal meaning of interest or Al-RIBA as it is used in the Arabic language means to excess or increase.
 In the Islamic terminology interest means effortless profit or that profit which comes free from compensation
Or that extra earning obtained that is free of exchange.

"Riba` is a loan with the condition that the borrower will return to the lender more than and better than the quantity borrowed."
The definition of interest has already been mentioned as well as that it is prohibited.
 If we explore the Qur’an we will come across at least four places where Allah Subhanahu WA Ta’aala (GOD) has mentioned interest.
In Islamic finance, Riba is commonly translated as interest rate or excess. The prohibition of Riba is the cornerstone of Islamic finance.

Riba symbolizes both the earning of money on money via a predetermined rate on a loan and a social injustice.
Although making profit is allowed in Islam, earning money on money is not, because there is no productive and/or trade activity creating additional wealth.
Riba also creates social injustice because lenders requiring interest on loans tend to profit from the weak position of borrowers.
 Thus, because social justice and fairness in business are the most important parts of muamalat (economic transactions),
Riba is prohibited by Shariah, or Islamic law.

Is it not amazing that a Muslim will never eat pork or drink alcohol because it is Haram (unlawful)?
 Never marry his mother, sister or daughter because it is also Haram,
Yet that same person has no problem devouring Riba (e.g. interest, usury)?
 Did you know that engaging in Riba is a major sin which could lead you to Hell?

Do you own a house?
Is it Riba or fee Based mortgage?
Will this house take you and your family to hell (Jahanam)?
Find out for yourself only you have the answer?
What is your answer to Allah Subhanahu WA Ta’aala (GOD)?

Understanding Riba...
Mortgage is a Haram Riba-Based Transaction:
 A mortgage is a Haram Riba-based transaction that is based on a loan
With interest in which the owner of the money takes as collateral the property
For the purchase of which the borrower is taking out the loan, until the debt has been paid off along with the interest (Riba).
If the debtor is late in making payments,
Then the owner of the money is entitled to sell the property and take back his money.

This transaction is offered by Riba-based banks or real estate mortgage companies,
And this transaction is done when the one who wants to buy a house chooses a house,
Then he goes to the mortgage company – or to the Riba-based Bank – to ask them to buy that house
And he agrees to pay the money in installments, plus the interest that has been agreed upon.
A representative of the company or bank meets with the owner of the house and the third party,
 Namely the borrower and the price of the house is paid in full to the owner.
In some cases the borrower pays part of the price (down payment).
And the contract is signed with the borrower for the money paid to the owner of the house plus the interest.
 The house is mortgaged to the Mortgage Company or bank that pays the money to the owner of the house.
 If the borrower fails to pay any installment on his loan,
 The mortgage company has the right to sell the house in order to get back the rest of the money that it is owed by the borrower.

This transaction clearly comes under the heading of blatant Riba. Allah Subhanahu WA Ta’aala (GOD),, may He be exalted,
 Has forbidden Riba and has issued a warning to those who consume it of a severe punishment as He, may He be exalted, says (interpretation of the meaning):

 Wordings are changed from "Interest" to "Fee".
Here in the UK, you cannot get Halal mortgages as they charge you a fee,
So the end result is you end up paying back more than you borrow.
They basically just change the wording from "interest" to "fee".
I don't know if the company you have selected does the same think.

But to put it simply, if you borrow £1500, 000
And end up paying back £1500, 000 only, then that is Halal.
 If you have to pay interest or a fee on top of that, then apparently it is not Halal.
Which one are you paying "Interest" or "Fee"? (It is not Halal)

“Those who eat Riba (usury) will not stand (on the Day of Resurrection) except like the standing of a person beaten by Shaitan (Satan) leading him to insanity. That is because they say: "Trading is only like Riba (usury)," whereas Allah Subhanahu WA Ta’aala (GOD), has permitted trading and forbidden Riba (usury). So whosoever receives an admonition from his Lord and stops eating Riba (usury) shall not be punished for the past; his case is for Allah Subhanahu WA Ta’aala (GOD),  (to judge); but whoever returns (to Riba (usury)), such are the dwellers of the Fire - they will abide therein”
[Al-Baqarah 2:275].

This Riba-based transaction is not permissible either in Muslim countries or non-Muslim countries;
It is not permissible in order to acquire houses or a shop.
Some contemporary scholars have permitted this Riba-based transaction if it is in a non-Muslim country
And it is done in order to acquire a house in which to live.
This permission is attributed to the Hanafi madhhab, and some evidence is quoted for it.
But many scholars have challenged this fatwa...

Here let’s examine the following Verses
The first one is in Surah Al-Baqarah verse no.275
"Those who devour usury will not stand except as stands one whom the Satan by his touch has driven to madness.
That is because they say, "trade is like usury", but Allah has permitted trade and has forbidden usury",

In the next verse 276 in the same place Allah Subhanahu WA Ta’aala (GOD) says,
"Allah will deprive usury of all blessing, and will give increase for deeds of charity, for he does not love any ungrateful sinner."

Two verses later in verse 278 Allah Subhanahu WA Ta’aala (GOD) says,
"Oh you who believe! Fear Allah and give up what remains of your demand for usury if you are indeed believers."

In verse 279 Allah Subhanahu WA Ta’aala (GOD) says,
"If you do not, take notice of war from Allah and his Messenger Sallallaahu alayhi wasallam
But if you repent you shall have your capital sum. Deal not unjustly and you shall not be dealt with unjustly."

In the second place in Surah Aal-Imran, verse no.130 Allah Subhanahu WA Ta’aala (GOD) says,
"Oh you who believe! Devour not usury doubled and multiplied; but fear Allah that you may prosper."

In the third place in Surah Al-Nisa’ Allah Subhanahu WA Ta’aala (GOD) states in verse 161,
"That they took usury though they were forbidden and they devoured people’s wealth wrongfully;
We have prepared for those amongst them who reject faith a grievous chastisement."

In the fourth place, Surah Al-Room, verse no.39 Allah Subhanahu WA Ta’aala (GOD) mentions
"That which you give in usury for increase through the property of people will have no increase with Allah:
But that which you give for charity seeking the countenance of Allah, it is these who will get a recompense multiplied."

Jabber RadiAllahu anhu has reported that:
 The Messenger of Allah Subhanahu WA Ta’aala (GOD), Prophet Muhammad (Sallallaahu Alayhi Wasallam), cursed the devourer of usury, its payer, its scribe and its two witnesses. He also said that they were equal (in sin)....” (Muslim)”.
Abu Hurairah RadiAllahu anhu reported that the Holy prophet Muhammad (Sallallaahu Alayhi Wasallam) said:
A time will certainly come over the people when none will remain who will not devour usury.
 If he does not devour it, its vapors will overtake him.
(Ahmed, Abu Dawood, Nisa’i, Ibn Majah.)

Abu Hurairah RadiAllahu anhu reported:
 That the Messenger of Allah Subhanahu WA Ta’aala (GOD) prophet Muhammad (Sallallaahu Alayhi Wasallam) said:
 Usury has got seventy divisions. The easiest division of them is a man marrying his mother.
(Ibn Majah)

Abu Hurairah RadiAllahu anhu reported:
 That the Messenger of Allah Subhanahu WA Ta’aala (GOD) prophet Muhammad (Sallallaahu Alayhi Wasallam) said:
I came across some people in the night in which I was taken to the heavens.
Their stomachs were like houses wherein there were serpents, which could be seen from the front of their stomachs.
I asked: O Gabriel! Who are these people? He replied these are those who devoured usury.
(Ahmed, Ibn Majah)
 Ali RadiAllahu anhu reported that he heard the Messenger of Allah Sallallaahu alayhi wasallam cursing the devourer of usury,
Its giver, its scribe and one who refuses to give Zakat and he used to forbid mourning.
(Nisa)
Umar bin Al-Khattab RadiAllahu anhu reported: the last of what was revealed was the verse of usury.
The Messenger of Allah prophet Muhammad (Sallallaahu Alayhi Wasallam),
 Was taken and he had not explained it to us. So, give up usury and doubt.
(Ibn Majah,)

Abdullah bin Hanzalah RadiAllahu anhu (who was washed by the angels)
 Reported that the Messenger of Allah prophet Muhammad (Sallallaahu Alayhi Wasallam), said:
A dirham of usury that a man devours and he knows is greater than 36 fornications.
(Ahmed,)

After narrating all these verses from the Qur’an and relating all the Ahadith it is apparent to us that interest could never be legal and Halal.
How could anybody even take the time out to think about a matter in which Allah Subhanahu WA Ta’aala (GOD), has declared war on the user
And his Beloved prophet Muhammad (Sallallaahu Alayhi Wasallam), has cursed him?
As sensible people we can understand that what our creator Allah Subhanahu WA Ta’aala (GOD)
 Has chosen for us is for our own prosperity only.

The prophets of Allah Subhanahu WA Ta’aala (GOD), Used to work hard for getting aliment as they were diligent over the Hereafter.
Our beloved Prophet Muhammad Sallallaahu alayhi wasallam) had a piece of land for agriculture;
Other prophets did not sit at home to receive free food but all of them were working hard.
The prophet (Musa) Moses Alayhi salaam remained herder for many years.
The prophet David Alayhi salaam was ordered by Exalted Allah to make armor.
Prophet Suleiman Alayhi salaam got aliment by liquid copper.
(.'The companions of holy Prophet Muhammad Sallallaahu alayhi wasallam) used to struggle for achieving aliment;
The first caliph Abu Bakr as-Sadiq (RadiAllahu anhu) was a cloth dealer.
The forth caliph, Ali (RadiAllahu anhu), despite his high dignity was working at the well of a Jew.
 None of Sahaba denied striving for the sake of his family members,’
But they did not indulge in Riba.
There life is an example to us. (You think you have a heard life? (Hmmm).
Halal aliment ensures safe life and a best future.
 Legal income is the requisite of honesty.
Most of the criminals committed sins and crimes due to their illegal incomes.
Haram income affects the whole way of life and all characters of the person.
On the other hand, legal income ensures the blest future of people. "Self-sufficiency" Is one of the best teachings of Islam.
While seeking aliment we must be sufficient.
Satiety makes a person rich in fact.
 Holding lots of money is not the sign of rich people but it is self-sufficiency that makes people rich
Halal applies not only to food products but to all aspects of life and social context.
One may hear mention of, "Halal money." What does this mean?
 For example, if a new religious center, school,
Hospital or any facility for social benefit is to be built,
 The funding must come from "clean" money or what is known as "Halal Income.” Money earned from gambling, the selling of alcohol, Pushing Drugs, any kind of illegal dealings.
 I.e. Drug trafficking, illicit social vices or any illegal activity is considered detrimental to society and therefore not acceptable or considered a Halal income.

We should deeply thank the Sahaba RadiAllahu anhuma in their efforts to spread the religion (Islam)
 As they learnt it from the prophet Muhammad (Sallallaahu Alayhi Wasallam),
Then when the religion started to spread vastly
Allah brought about four imams who described the religion in general terms in order to make the common public understand.
They spent their lives trying to put the whole religion in a collective form through the Qur’an and the Ahadith
And the concise decisions of the Sahaba RadiAllahu anhuma.
In the case of interest, all four imams established a general rule mainly concentrating
On this statement made by the prophet Muhammad (Sallallaahu Alayhi Wasallam),

Hazrat Al-Khudri RadiAllahu anhu reported that Prophet Muhammad (Sallallaahu Alayhi Wasallam), said:
Gold in exchange for gold, silver in exchange for silver, wheat in exchange for wheat,
Barley in exchange for barley, dates in exchange for dates, salt in exchange for salt is in the same category
And (should be exchanged) hand to hand, so who ever adds or demands increase he has practiced usury.
 The giver and taker are the same.

Once Sayyidina Sad said to Prophet Muhammad (Sallallaahu Alayhi Wasallam), 
Pray to Allah that He may accept my invocation.
Prophet Muhammad (Sallallaahu Alayhi Wasallam) said:
 Eat lawful food and for that your invocation will be accepted.
   
Prophet Muhammad (Sallallaahu Alayhi Wasallam), 
Mentioned about the worldly addicted men and said:
There are many men, who have got disheveled hairs,
Dust laden dresses, are tired in journey,
Whose food is unlawful; whose dress in unlawful,
And who have been maintained by unlawful food.
If they raise their hands and say:
'O Lord ' O Lord how can their invocation be accepted?
        : An angel residing in Baitul Muqaddas proclaims every night:
Saraf and Adal will not be accepted from a person who eats unlawful food.
Saraf means optional and Sunnat actions and Adal means compulsory duties.
In other words, compulsory duties and optional duties will not be accepted from him.
     
 If a man purchases a cloth with ten dirhams and if one dirham out of them is unlawful,
His prayer will not be accepted till a portion of that cloth remains in his body.
The fire of Hell is fit for the flesh which has been grown by unlawful food.
      
 If a man does not care where from he earns his wealth,
Allah Subhanahu WA Ta’aala (GOD) will not care
By which path he will enter Hell. He said:
There are ten shares of worship, nine of which are in lawful earnings.
He who passes times up to evening in search of lawful earnings
 Passes the night in a state of his sins being forgiven
And rises at dawn when Allah Subhanahu WA Ta’aala (GOD) remains pleased with him.
        If a man earns by sinful acts and gives it in charity or action of a kindness or spends it in the way of Allah Subhanahu WA Ta’aala (GOD).
Allah will throw him into Hell after collecting everything.
        The best of your religion is to keep away from unlawful things.
He said: If a man meets Allah Subhanahu WA Ta’aala (GOD) after refraining from unlawful things.
Allah Subhanahu WA Ta’aala (GOD) will give him reward of the entire Islam. In an earlier scripture,
Allah Subhanahu WA Ta’aala (GOD) said with regard to those who refrained from unlawful food:
I feel ashamed to take their accounts.
        One dirham of interest (usury) is more serious to Allah Subhanahu WA Ta’aala (GOD) than thirty fornications.
Stomach is the fountain of body and the veins come out of it.
When the stomach is sound, the veins come out with health,
And when it is unsound, they come out with disease.
Food in religion is like the foundation of a building.
When the foundation is strong and firm, the building stands straight and it can be raised up,
And if the foundation is weak and curved, the building inclines to a side.
    Allah Subhanahu WA Ta’aala (GOD) says: Is not he who establishes Fear of Allah Subhanahu WA Ta’aala (GOD) And Allah Subhanahu WA Ta’aala (GOD)'s pleasure in the foundation of his religion better than he who lays foundation by the side of Hell fire?

Out of the four imams,
Imam Abu Hanifa: ra
Imam Abu Hanifa (r.a.) has ruled that if the measurement system (volumetric or in compounds) is the same
 And the two items are in the same category, and then they should be sold in the same amount
And direct not in credit otherwise interest will be found.

Imam Shafi: r.a
Imam Shafi (r.a.) says that if the items are valuable and could be considered food then there is the chance of interest.

Imam Malik: r.a.
Imam Malik says that if the items are valuable and are edible then interest is a subject.

As you may have realized, giving and taking interest is unlawful. Unfortunately,
The basis of many of the transactions (especially in banking and insurance),
Personal or business involve interest.
Thus it is becoming increasingly difficult for the majority of the Muslims, Especially those who are commercially orientated to abstain from dealings involving interest.
Many of us purchase items on ‘Buy now, Pay later' schemes thinking that this sort of scheme is of great benefit to us.
Sadly, what we fail to recognize at the time of purchasing this ‘supposed bargain'
Is the fact that if we fail to pay the required amount at the due time, we will be liable to pay interest?

Now, suppose a couple of months ago, we were purchased an item on a
‘Pay later' scheme in which there was no question about us keeping up to date with payments,
However due to a change in our financial situation, we have failed to pay the required amount, and are paying interest now as a result.
 We would have joined a group of those unfortunate people who have been cursed by the Prophet Sallallaahu Alayhi Wasallam.

Please take this advice if anyone who is involved in any form of interest that individual should minimize his expenditure in these dealings
And if possible abstain completely from these transactions. (My advice is RIBA is Haram) In any case,
Every individual should continue to seek Allah Subhanahu WA Ta’aala (GOD)’s forgiveness.
The philosophy shows that a person who takes interest does not gain anything in reality but through the explanation of the Qur’an verse,

“Allah decreases interest and increases Sadqah"

That in reality the money just goes to waste and the person does not even realize,
And a person who gives money in the path of Allah Subhanahu WA Ta’aala (GOD), in whatever forms it may be,
Actually gains although in reality it seems as though he is loosing out.

Every person should take all necessary precautions in their financial and social dealings.
If a person neglects in keeping a watchful eye on financial dealings,
This negligence will slowly spread to other aspects of religion.
 This will have a very detrimental effect on religious matters.

The dealings of usury and interest are not only a disadvantage to us in this world
 But will also be a source of great discomfort and pain for us in the hereafter.
The Prophet Sallallaahu Alayhi Wasallam has informed us about the punishment that awaits those people who deal with interest:

“Hazrat Abu Hurairah RadiAllahu Anhu has reported the saying of the Prophet Sallallaahu Alayhi Wasallam
That during his ascension (Mi'raj), he noticed a group of men whose stomachs were bloated to the size of big rooms
And their wanting to move from their positions was impossible.
They would be crushed in a stampede by the friends of Fir’ awn.
The Prophet Sallallaahu Alayhi Wasallam seeing their condition asked Hazrat Jibra'eel Alayhi Salaam about their identity.
 He was informed that they were the people who indulged in dealings of usury and interest.”

Stop dealing in Riba:
  Once Sayyidina Abu Bakr RadiAllahu said to Sayyidina Muwayiah RadiAllahu: O Muwayiah, fear Allah and know that the day which goes, Out from you and the night which comes take you away from this world and near the hereafter.
There is such as searcher behind you from whom you can never save yourself.
 You have got a fixed limit which you cannot cross. The sooner you reach the limit, the searcher will arrest you:
The properties we are in will all pass away and what we proceed to still remains. Take to what is good and give up what is bad.

The summary of the matter is that interest is hazardous and should be abstained from in all manners.
 If anybody has a case they wish to solve then they should contact a Mufti and present their problem as it is.
I conclude by asking you
, is it really worth destroying the eternal life of the hereafter,
Just so that we may have a few more comforts in a life which can come to an end any moment.

And remember my friend What Prophet Sallallaahu Alayhi Wasallam said in his last Sermon:

Prophet Sallallaahu Alayhi Wasallam’s Last Sermon 
This Sermon was delivered On the Ninth Day of Dhul Hijjah, 10 A.H, in the Uranah Valley of mount Arafat.
"O People, lend me an attentive ear, for I don't know whether, after this year,
I shall ever be amongst you again. Therefore listen to what I am saying to you carefully
And take these words to those who could not be present here today.
 O People, just as you regard this month, this day, this city as Sacred,
So regard the life and property of every Muslim as a sacred trust.
Return the goods entrusted to you to their rightful owners.
 Hurt no one so that no one may hurt you.
Remember that you will indeed meet your Lord,
And that He will indeed reckon your deeds. Allah has forbidden you to take usury (Interest),
Therefore all interest obligations shall henceforth be waived...
 Beware of Satan, for your safety of your religion.
He has lost all hope that he will ever be able to lead you astray in big things,
So beware of following him in small things.
O People, it is true that you have certain rights with regard to your women,
 But they also have right over you.
 If they abide by your right then to them belongs the right to be fed and clothed in kindness.
Do treat your women well and be kind to them for they are your partners and committed helpers.
And it is your right that they do not make friends with any one of whom you do not approve, As well as never to commit adultery. O People, listen to me in earnest, worship Allah,
Say your five daily prayers (Salah), fast during the month of Ramadhan,
And give your wealth in Zakat. Perform Hajj if you can afford to.
You know that every Muslim is the brother of another Muslim.
You are all equal. Nobody has superiority over other except by piety and good action. Remember, one day you will appear before Allah and answer for your deeds.
So beware, do not astray from the path of righteousness after I am gone.
 O People, no prophet or apostle will come after me and no new faith will be born. Reason well, therefore,
 O People, and understand my words which I convey to you.
 I leave behind me two things, the Qur'an and my example, the Sunnah and if you follow these you will never go astray.
All those who listen to me shall pass on my words to others and those to others again;
And may the last ones understand my words better than those who listen to me directly.
Be my witness oh Allah that I have conveyed your message to your people."

I pray to Allah Subhanahu WA Ta’aala (GOD) save us from RIBA Ameen.
May Allah Subhanahu WA Ta’aala (GOD) help us to do that which He loves and which pleases Him?  Ameen.
May Allah Subhanahu WA Ta’aala (GOD) make our efforts sincere and keep us all on the straight path...........Ameen
